Agudah’s Appeal Denied, But Will Be Heard in Tandem with Roman Catholic Diocese on Nov. 3

Agudah Israel of America’s motion to appeal the decision to deny a temporary restraining order of the restrictions created by Gov. Andrew Cuomo for the the red zones was just denied by William J. Nardini, the circuit judge who heard the case.
Agudah’s appeal was heard today at the Thurgood Marshall United States Courthouse, which is located at 40 Foley Square in New York City.
Agudah Israel of America has joined forces with Agudah Israel of Kew Garden Hills, Agudah Israel of Madison, Agudah Israel of Baywater, Rabbi Yisroel Resimen, Rabbi Menachem Feifer, and Stephen Saphirstein to try to postpone Gov. Cuomo’s intensified restrictions in the red zones, whose restrictions can be lessened when the COVID positivity rate remains under 3.0 for 10 consecutive days.
According to the U.S. Court of Appeals for the Second Circuit, Agudah’s motion will now be heard at the same time as a similar motion brought by the Roman Catholic Diocese of Brooklyn by court panel a on Nov. 3.
